Open Access, Copyright and Digital Preservation Policy
The ESASP Journal – Scientific Journal of the School of Advocacy of OAB/SP is an open access publication, which means that all its content is made freely available immediately upon publication, without any cost to users or their institutions.
No Fees
Aligned with ESA OAB/SP’s commitment to the dissemination of legal knowledge, the journal adopts the Diamond Open Access model (also known as Platinum Open Access). This ensures that:
For Readers: All published content (articles, reviews, editorials) is freely and immediately accessible. There are no subscription fees or embargo periods.
For Authors: No fees are charged for submission, processing, or publication of articles (APCs – Article Processing Charges).
Copyright
Authors retain full copyright and grant the journal the right of first publication.
License of Use (Creative Commons)
All works published by the ESASP Journal are licensed under the Creative Commons Attribution 4.0 International (CC BY 4.0) license. This license allows:
Share — copy and redistribute the material in any medium or format for any purpose, even commercially.
Adapt — remix, transform, and build upon the material for any purpose, even commercially.
Under the following conditions:
Attribution — You must give appropriate credit, provide a link to the license, and indicate if changes were made. This must be done in any reasonable manner, but not in any way that suggests endorsement by the licensor.
No additional restrictions — You may not apply legal terms or technological measures that legally restrict others from doing anything the license permits.
Repository Deposit and Self-Archiving Policy
In strict alignment with international Open Science guidelines, the ESASP Journal adopts a maximum-level self-archiving policy, holding a Green classification in the Diadorim directory (IBICT).
Authors are actively encouraged and authorized to deposit their works in personal webpages, institutional repositories, or thematic repositories. This authorization is unrestricted, with no embargo period, and includes both the originally submitted version (preprint / version without peer review) and the final edited version (postprint / publisher PDF / version of record).
Both versions may be deposited at the time of official publication, aiming to ensure maximum democratization and rapid dissemination of legal knowledge.
The interoperability of this data is ensured through metadata export via the OAI-PMH protocol.
Digital Preservation and Archiving Policy
Committed to the preservation and security of scientific heritage, the ESASP Journal ensures the long-term digital preservation of its entire collection.
To this end, the journal is part of the Cariniana Network, the Brazilian national digital preservation network coordinated by IBICT (Brazilian Institute of Information in Science and Technology).
Through the LOCKSS protocol (Lots of Copies Keep Stuff Safe), we guarantee distributed and permanent archiving of our metadata and publications across a network of partner libraries.
This system ensures continuous, uninterrupted, and authentic access to articles, protecting them against loss even in cases of technical instability of the original platform.
