Ethics, Open Science, Interoperability and Scientific Integrity

Revista ESASP - Revista Científica Virtual da Escola Superior de Advocacia da OAB/SP adopts the definition of Open Access for all its scientific literature, making it freely, publicly, and unrestricted available in accordance with the principles of the Budapest Open Access Initiative (BOAI). We advocate for the publication of scientific articles without financial, legal, or technical barriers, allowing anyone to read, download, copy, distribute, print, search, and link to the full texts, use them as data for software, or use them for any other lawful purpose.

Interoperability and Technical Infrastructure

For editorial management, we use the Open Journal Systems platform (OJS 3.5), ensuring interoperability, automated indexing, and broad dissemination of scientific output. Our infrastructure meets the following standards:

  • OAI-PMH 2.0 Protocol: Full support for DRIVER 2.0 guidelines and OpenAIRE standards, with fully validated open metadata and repository.

  • Structured Metadata and Transparency: Use of the international Dublin Core standard for machine readability and adoption of the CRediT taxonomy (Contributor Roles Taxonomy) to detail individual authorship contributions.

  • Digital Preservation: The journal's collection is preserved by IBICT's Cariniana Network via the LOCKSS ecosystem, guaranteeing perpetual custody and continuous access to content.

Ethics, Scientific Integrity, and Responsible Assessment (DORA Commitment)

The journal strictly aligns with international standards for responsible scientific publication promoted by the Committee on Publication Ethics (COPE), the Code of Ethics of the American Educational Research Association (AERA), the Council of Science Editors (CSE), and the SciELO Guide to Best Practices. Revista ESASP's integrity policy is grounded in reliability, transparency, and ethical rigor applied to research methods and results.

As a signatory of the San Francisco Declaration on Research Assessment (DORA), Revista ESASP guides its editorial policy by the following commitments:

  • Evaluation by Intrinsic Merit: Manuscripts are evaluated exclusively on their scientific quality, originality, methodological rigor, and real socio-legal impact, categorically rejecting journal-based metrics (such as the Impact Factor) as a surrogate indicator of individual article quality.

  • Article-Level Metrics: We promote the tracking of research impact through individual article-level metrics of open access views and PDF downloads.

  • Authorship Integrity: We require transparent disclosure of each co-author's contribution via the CRediT taxonomy and the direct citation of primary sources.

Any breach of ethical guidelines will be impartially investigated by the Editorial Board, subject to applicable institutional sanctions and COPE flowcharts.

Evaluation Process and Author's Freedom of Expression

All submitted manuscripts undergo initial screening (desk review) and, if approved, are subjected to a Double-Blind Peer Review system. The process guarantees reciprocal anonymity between authors and reviewers, ensuring fairness, academic rigor, and the preservation of authors' scientific freedom of expression.

Plagiarism and Authors' Ethical Conduct

Authors are required to submit strictly original and unpublished work. The journal utilizes similarity detection software (such as CopySpider or equivalent) on 100% of submissions prior to peer review. Authors retain copyright of their work, licensing it under a Creative Commons Attribution 4.0 International license (CC BY 4.0).

Responsibilities of Editors

Editors evaluate manuscripts based on academic merit, methodological consistency, and alignment with the journal's scope, acting impartially, confidentially, and free from any discrimination based on race, gender, sexual orientation, belief, geographic origin, or political stance, as well as immune to conflicts of interest.

Responsibilities of Reviewers

Reviewers must treat manuscripts as strictly confidential documents, refraining from using or disclosing their content. They must provide critical, objective, constructive reviews fully grounded in scientific rigor, declaring any unexpected conflicts of interest whenever identified.

Policy on Corrections, Errata, and Retractions

Minor formal errors or inaccuracies identified after publication will be corrected via an Erratum. Proven cases of scientific misconduct, plagiarism, falsification, or data fabrication will result in the public Retraction of the article, maintained and linked to the original document in accordance with COPE formal guidelines.

Editorial Gratuity and Absence of Fees (Zero APCs)

Revista ESASP charges authors no submission, evaluation, processing (Article Processing Charges - APCs), or publication fees. The entire editorial and technological workflow is fully subsidized by the Escola Superior de Advocacia da OAB/SP (Diamond Open Access Model).

Policy on the Use of Artificial Intelligence (AI) Tools

The use of generative AI tools must be mandatorily declared by authors upon submission, with a clear indication of the tool used and its specific purpose in supporting research or writing. AI tools lack legal and ethical personality and cannot be listed as authors or co-authors. Human authors retain sole and full responsibility for all published content, ensuring its accuracy, authenticity, and compliance with the guidelines of CNPq Ordinance No. 2,664/2026.
