    Abstract

    The article examines the constitutionality of Law No. 14,711/23, the Legal Framework for Collateral, focusing on the validation of extrajudicial procedures by the Brazilian Supreme Court (STF). The methodology consists of the analysis of ADIs 7,600, 7,601, and 7,608, discussing the de-judicialization of the consolidation of ownership in fiduciary sales of movable assets and mortgage foreclosures. The results indicate that the STF considered the procedures constitutional, provided that the adversarial principle and full defense are ensured, interpreting that the economic efficiency of the credit market must coexist in balance with the essential core of fundamental rights and the inviolability of the home.
