    Abstract

    The article analyzes the donation contract from the perspective of the proposed reforms to the Brazilian Civil Code. The author focuses on the sensitive issue of donations made by spouses to third parties, especially in the context of extramarital relationships. It discusses the transition from the wording of Art. 550 of the current code to the new Art. 1.564-D, which addresses parallel unions, moving away from the typification of adultery for civil purposes and prioritizing rules against unjust enrichment for the resolution of property disputes.
