The possible unconstitutionality and inapplicability of criminal protection in the crime of bigamy

The study examines the constitutionality of the crime of bigamy in light of the principle of state secularism established in the 1988 Constitution. It analyzes how the imposition of the monogamous model and the maintenance of Christian holidays reflect a religious heritage that clashes with human freedom and dignity in a pluralistic society. The article proposes the decriminalization of bigamy, arguing that Criminal Law should not protect morality or religious dogmas, and that such conflicts should be resolved exclusively in the sphere of Family Law, similar to the revocation of the crime of adultery.
