State competence in the oversight of private education

This article analyzes the judgment of ADI 2.965, which discussed the constitutionality of norms in Goiás's Complementary Law No. 26/1998 regarding the state's education system. The methodology focuses on the conflict between the Union's competence to legislate on general education norms and the supplementary competence of the States. The result indicates that the Supreme Federal Court (STF) validated state oversight of private schools, but declared unconstitutional the state's requirement of a higher education degree for teachers in early childhood education, as it contradicts Article 62 of the federal LDB (Law of Directives and Bases of National Education), which allows for secondary-level training (normal modality).
