    Abstract

    This article analyzes the Brazilian Supreme Federal Court's judgment on Direct Action of Unconstitutionality (ADI) No. 5.043, regarding the interpretation of Art. 2, § 1, of Law No. 12.830/2013. The author explores the Court's decision to declare a partial unconstitutionality, without text reduction, of any interpretation that assigns private or exclusive authority to police commissioners for conducting criminal investigations. It discusses the investigative powers of the Public Prosecutor's Office and other administrative bodies, reinforcing the compatibility between the legislator's intent and the protection of the Democratic Rule of Law.
