Abstract

The interface between Psychology and Law in the Judiciary arises from an express legal imposition. Laws such as the penal execution and parental alienation laws, in addition to the Statute of the Child and Adolescent and the Civil Procedure Code, require psychological expertise for various demands. However, experts and technical assistants are subject not only to federal legislation, but also to regulations issued both by the Courts of Justice and by the Federal Council of Psychology itself, which can lead to normative conflicts. In this context, the present descriptive work was elaborated with the purpose of surveying and describing, albeit superficially, some real and apparent conflicts that arise in the conjugation of the norms of the Court of Justice of the State of São Paulo and the Federal Council of Psychology. The highlighted points are the performance of psychologists as technical assistants, as evaluators in the prison system and in cases of parental alienation, among others.

Assistant Professor Doctor at the Department of Psychology, Faculty of Sciences, UNESP-Bauru; Psychologist graduated from Universidade Paulista, Specialist in Couples and Family Therapy from PUC-SP. Master and PhD in Clinical Psychology from PUC-SP; Post-doctorate in Psychobiology from the Federal University of São Paulo.
