Reconfiguring paradigms: towards a new anti-discrimination lexicon in the context of civil liability
Keywords:
Anti-discrimination, Civil Liability, DignityAbstract
The article analyzes the need to update the legal lexicon in Brazilian civil liability to adequately address structural racism and intersectional discrimination. It examines how traditional concepts of moral damage and honor often fail to capture the complexity of discriminatory offenses. A paradigmatic reconfiguration is proposed, integrating Anti-discrimination Law and Compliance, aiming for full reparation that considers human dignity from a social and collective perspective, overcoming merely individualistic views of damage.
