Control judicial en comisiones de heteroidentificación
Keywords:
Civil Liability, Public Security, Topic 1.420Abstract
The article analyzes the understanding of the Brazilian Supreme Court (STF) regarding General Repercussion Theme 1,420, which addresses judicial review over the acts of hetero-identification panels in civil service examinations for vacancies reserved for Black and Mixed-race (pardo) individuals. The methodology focuses on the analysis of a case originating from Ceará, where the Judiciary annulled an administrative act due to a lack of objective criteria and a violation of the adversarial principle. The results confirm that the STF recognizes the possibility of judicial control over these acts to guarantee full defense and human dignity, although it is not within the Court's jurisdiction to re-examine the factual criteria of the public notice or the substantive grounds of the panel.
