Defense of legal profession prerogatives against legislative error

The Brazilian Supreme Federal Court decision in ADI 7,231 recognized the formal unconstitutionality of provisions of Law 14,365/2022. Due to a material error in the legislative process, essential prerogatives of the Lawyer's Statute—such as access to judicial records and professional immunity—were improperly revoked. The ruling characterized a violation of the due process of lawmaking (Articles 59 et seq. of the Constitution) and the democratic principle (Article 1, Constitution), based on the vote of Justice Flávio Dino.
