Abstract

The article analyzes affective abandonment from the perspective of civil liability in Brazilian Law. The author differentiates affection (a faculty) from care (a legal duty), arguing that compensation does not stem from the absence of love, but from the breach of the duty of assistance, coexistence, and support for children. The text covers doctrinal and jurisprudential evolution, highlighting the punitive and pedagogical function of financial reparation in the face of the violation of the personality rights of children and adolescents.
