This article aims to analyze the phenomenon of the existential minimum and the reserve of the possible in the face of the constitutional guarantee of the fundamental right to public health. Through the analysis of Supreme Court judgments, it sought to enter into the implementation of theories in the Brazilian jurisdiction. The theme is justified by dealing with current topics and concepts of great relevance, such as the judicialization of health and the fulfillment of public policies, under the bias of the theories established by Ronald Dworkin and John Rawls.
