Legislative delay in protection against domestic violence (LGBTQIA+)

This article analyzes the Brazilian Supreme Federal Court's judgment on Writ of Injunction (MI) 7.452, which recognized the National Congress's unconstitutional delay in passing protective legislation against domestic violence for men in same-sex relationships (GBTI+), trans women, and travestis. The author discusses the Court's unanimous decision regarding legislative omission and the majority ruling for the full application of Law No. 11,340/2006 to these groups, provided contextual factors of subordination are present. It highlights the legal recognition of the distinction between biological sex and gender as a cornerstone for protecting human dignity.
