Trademark Licensing Contract: Reflections in Light of the Concept of Economic Group Fixed by Law No. 13,467/2017

Abstract

The article analyzes the new legal configuration of the economic group after the 2017 Labor Reform, specifically the requirement for demonstration of integrated interest and joint action. The author investigates whether the industrial trademark licensing contract induces the formation of an economic group for labor purposes, concluding that, as it is a commercial business involving an isolated intangible asset and without managerial subordination, it does not characterize joint liability, except in cases of proven fraud.
