      Abstract

      The article analyzes the legal landscape of collective dismissals in Brazil eight years after Law No. 13,467/2017. The authors discuss the introduction of Art. 477-A of the CLT, which equates individual, plural, or collective dismissals without cause, and the impact of the STF judgment on Theme 638. It concludes that, although prior union authorization was waived, the duty of prior union intervention (dialogue and negotiation) remains before implementing cuts, aiming to mitigate the social impacts of mass layoffs.
