    Abstract

    The article evaluates the contribution of the Civil Code Reform Commission to the refinement of Damage Law in Brazil. The author discusses the character of the 2002 Civil Code as a milestone of the "second codification wave," characterized by open and intentionally indeterminate norms. It analyzes how the reform seeks to improve legal certainty and the governance of private relations, balancing regulatory flexibility with the need for predictability in judicial decisions.
