    Abstract

    The study examines the declaration of unconstitutionality of Law No. 12,430/2024 of the State of Mato Grosso by the STF in ADI 7,715. The regulation imposed administrative restrictions on illegal property occupants, which was invalidated for invading the exclusive competence of the Union to legislate on Criminal Law and general bidding rules. The decision reaffirms the limits of state autonomy and protects fundamental rights against sanctions without due process of law.

       Lawyer, Judicial Expert, and Knight. Master in Education from UNICAMP, with degrees in Law, Business Administration, and Pedagogy.
