Legal Proceduralization Techniques in Biolaw and Complex Responses to Scientific and Ethical Development in the 21st Century

Faced with the insufficiency of positivist legal techniques for legal decision-making and nomogenesis, this article studies the application of judicial proceduralization techniques in bioethical analysis situations. Based on the study of real factual situations, it seeks to demonstrate the importance of basing on fundamental rights and the use of proceduralization techniques to achieve appropriate responses in situations of absence of law, allowing Law to offer solutions to conflicts arising from scientific and technological development.
