Unconstitutionality of mandatory free plastic bags

This article examines the judgment of ADI 7,719, in which the Brazilian Supreme Federal Court declared the unconstitutionality of Paraíba State Law No. 9,771/2012. The law mandated commercial establishments to provide free packaging to consumers. The STF established that such obligations violate the principle of free enterprise (Articles 1, IV, and 170 of the Constitution), emphasizing that state intervention in economic activity must be exceptional and based on proportionality.
