Payment of super-preferential court orders and small value requisitions (RPV)

This article discusses the constitutionality of paying super-preferential installments of court-ordered payments (alimony-related credits for the elderly or people with disabilities/serious illnesses) through Small Claims Requests (RPV). The methodology is based on the analysis of General Repercussion Theme 1.156, where the Brazilian Supreme Court (STF) evaluated the conflict between the protection of vulnerable individuals and fiscal discipline. The established thesis determines that the payment of super-preferential credits must be made mandatorily through court-ordered payments, except if the total value of the credit falls within the legal limit for RPV. The STF reaffirmed that the constitutional priority guarantees the anticipation of payment, but does not alter the nature of the requisition instrument (court-ordered payment vs. RPV).
