    Abstract

    The article analyzes the evolution of the simulation institute during the two decades of the 2002 Civil Code's validity. The author revisits the historical transition from the 1916 Code, where simulation was a cause of voidability, to the current regime, which defines it as a cause of absolute nullity of the legal transaction. It explores the distinction between absolute and relative simulation, the preservation of the concealed transaction when valid in substance and form, and the relevant jurisprudential change that allows one of the parties to allege simulation against the other, overcoming the old principle that no one can benefit from their own wrongdoing.
