Abstract

This article analyzes the Brazilian Supreme Federal Court's judgment on Theme 1,277 of General Repercussion, which discussed the constitutionality of Art. 3, § 3, of Law 10,259/2001 in light of Art. 109, § 2, of the Federal Constitution. The author examines the Court's unanimous decision establishing that the absolute jurisdiction of Federal Special Courts (JEFs) is restricted to the value of the case, and does not suppress the plaintiff's constitutional prerogative to choose the territorial venue for filing lawsuits against the Union or federal indirect administration entities. The analysis highlights the harmonization between the regional expansion of the Federal Justice system and the guarantee of broad access to jurisdiction.
