Incident of Disregard of Legal Personality: Application in Labor Proceedings

    Abstract

    The article analyzes the implementation of the Incident of Disregard of Legal Personality (IDPJ) in labor proceedings after the Labor Reform (Law No. 13,467/2017) and the CPC/2015. The author examines the historical origin of the institute (disregard doctrine) and how its application aims to reconcile enforcement speed with the constitutional guarantees of adversarial proceedings and full defense for partners. It concludes that the law's enforcement demonstrated that the incident did not hinder executions but provided greater legal certainty by limiting late objections.
